Second Circuit Upholds FDNY Vaccine Mandate From Due Process Claims

The Second Circuit has upheld the suspension without pay, and in some cases the dismissal, of some 86 FDNY firefighters who refused to comply with the city’s vaccine mandate in 2021. The firefighters alleged that the city’s failure to bargain over the vaccine mandate, coupled with the failure to comply with the city’s normal disciplinary requirements, constituted a violation of their due process rights.

A lawsuit filed by a Los Angeles County firefighter challenging the COVID19 vaccine mandate as violating the Americans with Disabilities Act, has been dismissed. Marcia Wilson filed suit in April contending that she was being discriminated against on account of a perceived disability.

Judge Upholds Illinois Vaccine Mandate

A federal district court judge has upheld a vaccine mandate ordered by Illinois Governor Jay Robert Pritzker, from a challenge brought by six Naperville firefighters. The lawsuit filed in September claimed the vaccine mandate exceeded the governor’s authority, and violated the firefighters’ constitutional rights.

Firefighter Vaccine Lawsuits in the Headlines

Firefighter vaccine lawsuits are once again in the Fire Law headlines. In Los Angeles County, a group of 574 firefighters filed suit to challenge the county’s vaccine mandate. The suit was filed in Los Angeles County Superior Court by LA County Free Foundation alleging a violation of the employees’ due process and privacy rights.

The Widening Gulf in the COVID19 Vaccine Battle

A firefighter-plaintiff in a lawsuit challenging the legality of a COVID19 vaccine mandate in Orange County, Florida, has been terminated for refusing to issue reprimands to firefighters who did not get vaccinated. That in turn has prompted Florida’s Governor Ron DeSantis to call for a special legislative session to enact laws that would prohibit such terminations.

RI Court Rejects Firefighters Vaccine Mandate Challenge

A Superior Court judge has rejected a request by the Rhode Island State Association of Firefighters for an injunction to block the state health department from implementing a COVID19 vaccine mandate. The suit sought an injunction against the state’s planned COVID19 vaccine requirement on the grounds that it violates collective bargaining laws by imposing a mandatory condition of employment on firefighters.

Oregon Firefighters Sue to Block Vaccine Mandate

A firefighters’ union and a union representing state troopers along with individual members have filed suit against Oregon Governor Katherine Brown and the state alleging the recently announced vaccine mandate is illegal under state and federal law. Kingsley Firefighters Association, Inc. and the Oregon Fraternal Order of Police filed suit in Jefferson County Circuit Court.
