Massachusetts Consent Decree on Racial Quotas to Expire at the End of 2024

A federal court has ruled that a fifty-year-old consent decree that mandated strict race-conscious hiring quotas for Massachusetts fire departments has achieved its intended goals in all but three communities, and will be terminated on December 31, 2024. The consent decree was the result of a series of lawsuits brought in the early 1970s by the Boston Chapter of the NAACP.

Hartford Prevails in Race Discrimination Suit

A lawsuit filed by a Hartford firefighter who claims he was discriminated against on account of his race and age, has been dismissed by the US District Court for the District of Connecticut. An FDNY firefighter who claimed he was sexually assaulted and racially discriminated against when assigned to his first firehouse after the fire academy, is appealing entry of judgment in favor of the city. Gordon Springs filed suit against the city and several firefighters in 2017.

Houston Prevails in Race Discrimination Suit

The Texas Court of Appeals has ruled in favor of the City of Houston in a race discrimination suit brought by a probationary firefighter who was dismissed toward the end of his probationary period. Madison T. Garner filed suit contending his termination in 2016 was based upon his race, and that he was subjected to a racially hostile work environment.

The City of Chicago and the US Department of Justice have agreed to dissolve a 42-year-old consent decree that has governed promotions within the Chicago Fire Department since 1980. The race-based consent decree governed the promotional process from engineer through battalion chief within the department for the past four decades.

California Firefighter Files Fourth Race Discrimination Lawsuit

A California firefighter who filed three prior race discrimination lawsuits before being terminated last year, has filed a fourth suit. Vernon Creswell, who was a captain with the Montebello Fire Department until January 5, 2021, filed suit on May 9, 2022, alleging retaliation for his previous claims.
