More FLSA Overtime Suits Out of West Virginia

Fifty-six firefighters with the Morgantown Fire Department have filed two suits claiming the city has not been paying them properly for overtime. One suit was filed in US District Court for the District of West Virginia and the other in Monongalia Circuit Court.

All forty-four members of the Clarksburg Fire Department have filed suit claiming the city’s method of calculating their hourly rate, regular rate and overtime rate violates the FLSA. FDNY Fire Inspectors File FLSA Overtime Suit

Twenty-six fire inspectors for FDNY have filed suit in federal court claiming the city failed to pay them overtime compensation in accordance with the Fair Labor Standards Act. The inspectors claim they routinely work in excess of their regularly-scheduled forty hours per week, are not compensated for those extra hours unless they are pre-approved.

Massachusetts Firefighters Alleged Overtime Violations

Two Brookline fire lieutenants have filed a class action lawsuit claiming the town failed to pay them overtime as required by the Fair Labor Standards Act. Lieutenants Brian Bergeron and Paul Trahon filed suit in US District Court for the District of Massachusetts on behalf of 150 similarly situated firefighters.

A class action Fair Labor Standards Act suit brought last year by EMTs in Livingston County, Michigan has been settled for $150,000. The suit was brought by five EMTs who alleged that the county miscalculated their regular rate, which in turn led to a miscalculation of their overtime compensation.

In other words, our hourly rate for overtime purposes is calculated by dividing the weekly salary by 56 hours. Shouldn’t they use 53 hours since the FLSA states that is the maximum allowable number of hours per week for firefighters?

118 California Firefighters File FLSA Overtime Suit

Firefighters in Santa Rosa have filed a class action lawsuit claiming the city has been improperly calculating their overtime pay in violation of the FLSA. The suit was filed last week in federal court by 118 Santa Rosa firefighters.
