Albany Prevails In Suit Over Demolition of Building After Fire

The US District Court for the Northern District of NY has concluded that the Albany Fire Department and the City were within their rights to order the demolition of a vacant rowhouse after it was badly damaged in a 2011 fire. The suit filed by the building’s owners accused the city of depriving them of their property without due process.

Arkansas Fire Suit Headed for Trial

A lawsuit filed by property owners whose building in Nashville, Arkansas was demolished in 2010 after fire destroyed a neighboring building will finally be making its way to trial. Carl and Justin Johnson, who owned “Collectible Corner”, filed suit back in 2011 claiming city and fire department officials were responsible for the unnecessary destruction of their building.

PA Property Owner Sues Over Post Fire Demolition

The owner of a house in Wilkes-Barre, Pennsylvania is suing the city claiming it wrongfully ordered the demolition of the building three days after a fire last November. Melinda Deiter and her father, John Deiter, filed suit earlier this year claiming the city’s order to demolish the building was a violation of their due process and 4th Amendment rights.
