San Diego Firefighter Loses Appeal of Suspensions

A San Diego firefighter who was suspended over two incidents that occurred in 2012 and 2013, has lost his appeal to have the discipline overturned by the California Court of Appeals. The firefighter was involved in separate incidents February 2012 and January 2013 that each resulted in a 24-hour suspension.

Tennessee Supreme Court Upholds Termination of Firefighter

The termination of a Tennessee firefighter who was fired in 2015 following an off-duty altercation, has been upheld by the Tennessee Supreme Court. Paul Zachary Moss was fired by the Shelby County Fire Department following a no-contest plea to charges that he assaulted two men with a firearm.

Collateral Damage Discipline of Boston Lieutenants Reversed

In a particularly blunt decision, the Massachusetts Civil Service Commission has overturned the discipline of two Boston fire lieutenants referring to them as “collateral damage for what appears to be a strategic move to counter” race discrimination allegations. Lt Marc Hayhurst and Lt Brian Summering were suspended for two tours each.

Use of Racial Slur Warrants Termination of Boston Jake

The Massachusetts Civil Service Commission has upheld the termination of a Boston firefighter for his use of the N-word in the firehouse while off-duty. Gregory R. LaVallee, a 14-year veteran of the Boston Fire Department, was terminated on March 15, 2019 over an incident that occurred on December 13, 2018.

A Shreveport firefighter who was disciplined for an act of violence against a woman in front of a fire station in January 2015, and then terminated following a second incident with a different woman in November, 2015, has lost his appeal for reinstatement before the Louisiana Court of Appeals.

Tennessee Appeals Court Rules Full Back Pay Proper for Firefighter Fired Over Mere Arrest

The City of Memphis has been ordered to provide “full back pay and benefits” to a firefighter who was wrongfully terminated in 2014 following a drunk driving arrest. Allen K. Wallace, a 13 year veteran of the Memphis Fire Department, was fired following his arrest on October 18, 2014.

A Newark firefighter who was terminated in 2016 after falling asleep in a firehouse kitchen, missing a run, and testing positive for drugs and alcohol, has lost his appeal to the Appellate Division of the NJ Superior Court. Mass Judge Denies Stay of Civil Service Reinstatement Order

A Suffolk County Superior Court judge has refused the request of the City of Brookline, Massachusetts to stay a Massachusetts Civil Service Commission order to reinstate an African American firefighter who was terminated in 2016.
