FDNY Hearing Loss Case Reinstated

One hundred and fifty FDNY firefighters who filed suit in Pennsylvania against American LaFrance and Federal Signal Corporation, got good news yesterday as the Pennsylvania Superior Court reinstated their hearing loss claims. The firefighters were grouped into seven separate cohorts that filed separate lawsuits in the Court of Common Pleas of Philadelphia County in 2015.

Firefighters Must Pay Federal Signal’s Attorneys Fees In Hearing Loss Loss

The US Third Circuit Court of Appeals has upheld a trial court ruling awarding Federal Signal Corporation more than $127,000 in legal fees and costs from a group of eleven Washington DC firefighters. The suit was originally filed against E-One, Inc., Pierce Manufacturing, Inc, Seagrave Fire Apparatus, LLC, and Federal Signal Corporation for product liability associated with their hearing loss.

Pennsylvania Firefighters Refile Hearing Loss Suits Against Federal Signal

Seventy Pennsylvania firefighters filed suit this week against siren manufacturer Federal Signal Corporation claiming hearing loss from exposure to “loud, excessive and harmful noise levels.” The firefighters from Scranton, Dunmore and Wilkes-Barre filed a total of five lawsuits after similar suits they filed in Illinois were dismissed earlier this year.

NJ Hearing Loss Case Removed to Federal Court

A hearing loss case filed earlier this year by 34 New Jersey firefighters has been removed from state Superior Court to US District Court at the request of Pierce Manufacturing, Inc. The case was brought by the firefighters against American Lafrance, Federal Signal, Kovatch Mobile Equipment, Mack Trucks, Inc., Pierce, and Seagrave Fire Apparatus claiming the defendants are responsible for their hearing loss as a result of repeated exposure to siren noise.

A firefighter from Eugene, Oregon who was injured during a training exercise in 2012 is suing an SCBA manufacturer and a local vendor. David Pickett, 35, was injured on December 19, 2012 when an MSA Firehawk M7 SCBA malfunctioned causing an explosion that he claims seriously damaged his hearing.
