Court Rules FDNY Must Accommodate Facial Hair Despite OSHA

A federal judge has ruled that FDNY must reinstate an accommodation granted to African American firefighters suffering from Pseudofolliculitis Barbae that permits facial hair in the chin, cheek and neck area provided it does not cause leakage around the mask's seal. The firefighters filed suit in 2018 alleging race and disability discrimination.

FDNY Gets Split Decision in Trademark Suit

A federal court has upheld in part and denied in part a trademark infringement suit brought by the City of New York against a vendor who refused to stop selling FDNY and NYPD t-shirts and memorabilia. The city sued Blue Rage, Inc. doing business as The Cop Shop alleging it sold “a wide variety of unlicensed, infringing merchandise bearing the NYPD and FDNY Trademarks.”

A lawsuit brought by the husband of a woman who died when an FDNY ambulance responding to her apartment was flagged down by police officers for another incident, has survived its first challenge, courtesy of the special duty rule. A Muslim FDNY firefighter who claims the city granted him a religious accommodation from its no beard requirement, and then without cause withdrew it last year, has filed a religious discrimination suit. Steven Daniel filed suit alleging the city’s refusal to continue to allow him to maintain “close-cropped facial hair” constitutes illegal religious discrimination.

Fire Victims’ Family Seeks $2.2 Billion from New York City

An attorney representing the daughter of a woman who died in a fire along with her five children, has filed a claim with the city of New York for $2.2 billion alleging the city did not do enough to protect them as residents in a public housing project. Attorney Evan Oshan filed the claim on behalf of Raven Reyes, the daughter of Andrea Pollidore.

An EMT with FDNY who was denied a firefighter’s position due to his age, has filed suit alleging age discrimination. Daniel P. O'Donoghue filed suit earlier this month naming FDNY Fire Commissioner Daniel Nigro and the City of New York as defendants. O'Donoghue filed the suit pro se in US District Court.

The New York Supreme Court for New York County has upheld a nuisance alarm citation imposed by FDNY on a business despite the fact the business was operating on state property. Genting New York, LLC challenged the nuisance alarm citation as illegal claiming the city lacked the jurisdiction over businesses on state owned property.
