Suit Alleges Lemon Law Violation Over Defective $1.4 Million Aerial Platform

An Illinois fire department has filed suit against Seagrave Fire Apparatus, LLC, alleging breach of contract, breach of warranty, and violation of the state’s “lemon law” due to problems with a new 105-foot Apollo aerial platform. The Lockport Township Fire Protection District filed suit today in US District Court for the Northern District of Illinois.

Illinois Cities Suing Pierce Over Warranty Claims

The City of Charleston, Illinois is joining six other municipalities in filing a class action lawsuit against Pierce Manufacturing, Inc. over a breach of warranty claim on fire apparatus. The lawsuit alleges that Pierce and Global Fire Equipment Inc. granted a lifetime warranty on the frames of its fire trucks for rust and corrosion damage.

NJ Hearing Loss Case Removed to Federal Court

A hearing loss case filed earlier this year by 34 New Jersey firefighters has been removed from state Superior Court to US District Court at the request of Pierce Manufacturing, Inc. The case was brought by the firefighters against American Lafrance, Federal Signal, Kovatch Mobile Equipment, Mack Trucks, Inc., Pierce, and Seagrave Fire Apparatus claiming the defendants are responsible for their hearing loss as a result of repeated exposure to siren noise.

St. Pete Firefighters Sue MSA Over Cairns 1044 Helmets

Four St. Petersburg, Florida firefighters filed suit against Mine Safety Appliances and a local vendor earlier this month claiming that their Cairns 1044 fire helmets injured their necks and backs. They join firefighter Scott Crowell who filed the identical suit in 2013.
