Dismissal of Wilmington LODD Suit Upheld by Third Circuit

The 3rd Circuit has upheld the dismissal of a suit brought by the estates of three Wilmington firefighters who were killed and three others who were injured in a 2016 building fire. The fire claimed the lives of LT Christopher Leach, FF Ardythe Hope, and FF Jerry Fickes. FF Brad Speakman, FF Terrance Tate, and LT John Cawthray, were seriously injured during the rescue efforts.

Nova Scotia OHS Division Files Charges Against Fire School Over LODD

Nova Scotia's Occupational Health and Safety Division has cited the Nova Scotia Firefighting School with two charges in connection with the death of a firefighter last year. Truro firefighter Skyler Blackie died on March 20, 2019, eleven days after he was injured in an explosion at the Nova Scotia Firefighting School.

The family of a helicopter pilot who was killed battling the Hills Fire in California earlier this year has filed a wrongful death suit against two helicopter maintenance providers. Michael Fournier died on August 19, 2020 when the UH-1H Huey helicopter he was flying lost its hydraulics and crashed.

Woman Sentenced in Wilmington LODD Fire

A woman who pled guilty to setting the fire that killed three Wilmington, Delaware firefighters, has been sentenced to thirty years in prison. Beatriz Fana-Ruiz was sentenced last week for the September 24, 2016 fire that killed Lt. Christopher Leach, FF Jerry Fickes, and FF Ardythe Hope.

LODD Widow Sued For Money Owed On Damaged Bar

There has been an unusual twist in the litigation arising out of the line of duty death of Captain Cory Barr, who was killed in a natural gas explosion in Sun Prairie, Wisconsin last July. Captain Barr’s widow, Abby, is now being sued by Ski and Ski LLC, who sold the Barrs a bar, which was subsequently destroyed in the blast.

Honolulu Settles LODD Suit for $5 Million

Honolulu has agreed to settle with the family of a firefighter killed during a water rescue training exercise in 2016 by paying $5.25 million. Clifford Meredith Rigsbee died on June 14, 2016 while participating in water rescue training on the southeast shore of Oahu near Diamond Head.

Conviction of Arsonist in Ohio LODD Upheld

The conviction of a man accused of arson and murder for the 2015 fire that killed Hamilton, Ohio firefighter Patrick Wolterman has been upheld by the Twelfth Appellate District Court of Appeals. Lester Parker was charged with hiring his nephew, co-defendant William Tucker, to set fire to Parker’s home in order to collect the insurance proceeds.
