A Massachusetts firefighter and his fire department will have to travel to Connecticut to defend themselves in a civil suit arising out of an accident which occurred in Hartford in 2019. Ileana Torres filed suit against firefighter Zachary Lemieux, the Brimfield Fire Department and Town of Brimfield, Massachusetts.

Insurer Sues Over Apparatus Fire

A lawsuit has been filed by an insurer over a fire that destroyed a West Virginia fire truck in 2019. The Arch Insurance Co. filed suit this month against Shaffer Ford and Ford Motor Company for the destruction of a 2004 Ford F-Super Duty 550 owned by the Aurora Volunteer Fire Department.

NC Fire Department Sued for Death of Woman Run Over on Beach

The estate of a Virginia woman who died after being run over by a fire department pickup truck while lying on a North Carolina beach has filed suit against the fire department and the vehicle’s driver. Martha Mackey DeMontpellier died on September 14, 2019 after being struck by a Chevrolet Silverado belonging to the Chicamacomico Banks Fire Department.

A Nevada fire department and a battalion chief are facing a wrongful death suit over a 2018 accident that killed two people. The Central Lyon County Fire Protection District and BC Brett Larkin are being sued by the family of Joseph House Jr., who died in a motor vehicle accident on August 21, 2018.

Fatal Collision Prompts Suit in Mississippi

The family of a man killed in a collision with a responding fire chief in Mississippi last year, has filed suit against the county fire council and the chief. Kenneth Fitzgerald was killed when the vehicle he was riding in collided with a Ford F-350 owned by the Jones County Volunteer Fire Department Council and operated by Fire Chief Anthony Pitts of the Soso Volunteer Fire Department.

NJ Firefighter Injured By Apparatus Following Celebration Files Suit

A New Jersey firefighter who was injured last year in a mishap with an engine following an out of town celebration, is suing the department and several firefighters. Brian Smith was part of a three-person crew from the South Hackensack Fire Department that took an engine to attend a “wet down” party at the Fair Lawn Fire Department on June 23, 2018.

NY Firefighter Struck By Motorist Prevails

A New York Supreme Court judge has found that a driver who struck a firefighter directing traffic at the scene of a vehicle accident, is liable to the firefighter and his wife for his injuries. Kyle J. Pierce, a volunteer firefighter with the Sherburne Fire Department, was directing traffic at an accident scene on November 15, 2016 when he was struck by a vehicle operated by Thomas O. Bigelow.

Ohio Fire Department’s Immunity Upheld as SC Refuses to Hear Appeal

The Supreme Court of Ohio has refused to overturn a court of appeals decision granting immunity to a fire department in a suit over the death of a woman who was backed over by a fire truck. Lorri Riehm was killed in 2016 when she was run over by a Green Springs Rural VFD vehicle that was repositioning at the scene of a water rescue incident.
